Flash Motors Company Limited (“we” or “us” or “our”) respects the privacy of our users (“user” or “you” or “your”). This Privacy Policy briefly describes how your Personal Data is collected, used, stored, disclosed, erased and/or destroyed when you visit, access and/or use our electric vehicle charging mobile application (the “Application”). It also describes the rights which you may have in relation to the Personal Data which is collected, used, stored, shared, erased and/or destroyed by us. Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, including any third-party applications, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

DEFINITION

“Personal Data” means any information that relates to an identified or identifiable individual.

COLLECTION OF YOUR PERSONAL DATA

We may collect Personal Data about you in a variety of ways. The Personal Data we may collect via the Application depends on the content and materials you use, and includes:

Personal Data

Demographic and other personally identifiable information including but not limited to your name, email address, residential address, phone number, banking details, credit card information or tax identification number that you voluntarily give to us when choosing to participate in various activities related to the Application.

 Geo-Location Information

We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings but the location-based services will cease to work.

Mobile Device Access

We may request access or permission to certain features from your mobile device, including your mobile device’s [list all features that your app can connect to (eg. bluetooth)]. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data

When you access the Application by or through a mobile device, we may collect certain information including but not limited to your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

Push Notifications

We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Information required by law

Any data or information which we are legally bound to collect to comply with Know Your Client (“KYC”) and anti-money laundering regulations as well as to comply with any other regulations, orders, statutes or law.

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use Personal Data collected about you via the Application to:

  • Email you regarding your account or order;
  • Enable user-to-user communications;
  • Fulfill and manage purchases, orders, payments, and other transactions related to the Application;
  • Generate a personal profile about you to make future visits to the Application more personalized;
  • Increase the efficiency and operation of the Application;
  • Monitor and analyze usage and trends to improve your experience with the Application;
  • Notify you of updates to the Application;
  • Process payments and refunds;
  • Request feedback and contact you about your use of the Application by email, telephone call, SMS or other equivalent forms of electronic communication;

  • Solicit support for the Application.

We may share your Personal Data with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

We may share your Personal Data with our business partners to offer you certain products, services or promotions relating to the Application.

Transfer to another jurisdiction

Your Personal Data is processed at our operating offices and in any other places where the parties involved in the processing are located. It means that your Personal Data may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

TRACKING TECHNOLOGIES

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Application to help customize the Application and improve your experience. When you access the Application, your Personal Data is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Application. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer Personal Data to these third-party vendors.

You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.

THIRD-PARTY WEBSITES

The Application may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Application, any Personal Data you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your Personal Data. Before visiting and providing any Personal Data to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your Personal Data. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Application.

SECURITY OF YOUR PERSONAL DATA

We use administrative, technical, and physical security measures to help protect your Personal Data. While we have taken reasonable steps to secure the Personal Data you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any Personal Data disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide Personal Data.

All of our directors, officers, employees, affiliates, agents, contractors, service providers or licensors and data processors (i.e. those who process your Personal Data on our behalf, for the purposes listed above), who have access to, and are associated with the processing of your Personal Data, are obliged to respect the confidentiality of such Personal Data.

We do not warrant nor do we make any representations that your Personal Data may not be accessed, used, disclosed, altered, or destroyed by breach of such safeguards. We will notify you immediately and no later than 72 hours in the event of a security breach affecting your Personal Data and will maintain an incident response policy that includes notifications consistent with applicable law.

Your Rights

You have the right to access Personal Data we hold about you and to ask that your Personal Data be corrected, updated, or deleted. 

You have the right to ask us to stop processing your Personal Data in certain circumstances, for example, where the processing is likely to cause substantial damage or distress. You also have the right to object where we are processing your Personal Data for direct marketing purposes. You may opt-out of receiving direct marketing from us at any time.

If we rely on your explicit consent for processing your Personal Data, you may withdraw your consent at any time. However, we note that this will not affect the lawfulness of any processing carried out before you withdraw your consent. Accordingly, if you withdraw your consent, we may deny you access to our services.  We will of course advise you, if this is the case, at the time you withdraw your consent.

Please note that some of these rights may be limited where we have an overriding interest or legal obligation to continue to process your Personal Data.
